Makini by Twaja Terms of Service

1. Introduction
Makini is an online platform designed to facilitate group accountability and facilitate
communication among members of the group (the "Service"). By using the Service, you ("User") agree to be
bound by these Terms of Service.
2. Acceptance
The User accepts these Terms of Service by:
- Registering for a Makini account;
- Using the Service; or
- Clicking on the "I accept or equivalent" button during the registration process.
3. Definitions
In these Terms of Service, the following terms have the meanings set forth below:
- Account: A unique identifier and password used to access the Service.
- Content: Any information, text, images, videos, audio files, or other materials provided by Users
through the
Service, including financial data, receipts, and contribution records.
- Makini: The online platform and service operated by Twaja.
- Twaja: Twaja Engineering, creators and developers of Makini.
- User: An individual who uses the Service to manage group finances, track contributions, and keep
receipts.
4. Purpose
The purpose of the Service is to provide a platform for groups to:
- Track contributions made by members;
- Keep digital copies of receipts;
- Record and update financial information in real-time; and
- Share this information with group admins and members for transparency and accountability.
5. User Conduct
In using the Service, the User agrees not to:
- Use the Service for any illegal purpose;
- Post Content that is obscene, defamatory, invasive of privacy, or infringes on intellectual property
rights;
- Engage in behavior that harasses, threatens, or intimidates others;
- Attempt to gain unauthorized access to the Service, Accounts, or systems of Twaja or other Users;
- Use the Service for commercial purposes without prior written consent from Twaja; and
- Share false or misleading information about a group's financial activities.
6. Account Security
The User is responsible for maintaining the confidentiality of their Account login credentials and ensuring
that
all use of their Account complies with these Terms of Service. The User agrees to:
- Keep their Account information up-to-date and accurate;
- Notify Twaja immediately if they suspect any unauthorized access or use of their Account; and
- Take reasonable steps to secure their Account, including using strong passwords and keeping them
confidential.
7. Content Ownership
The User retains ownership of all Content provided through the Service. By providing Content through the
Service, the User grants Twaja a non-exclusive license to:
- Use, modify, and display the Content;
- Distribute the Content in connection with the Service; and
- Store the Content on servers operated by Twaja.
8. Warranty Disclaimers
Twaja disclaims all warranties, express or implied, including but not limited to:
- The Service will meet the User's requirements;
- The Service will be uninterrupted, timely, secure, or error-free;
- The accuracy, reliability, completeness, or truthfulness of Content provided through the Service; and
- The Service is free from malware or viruses.
9. Limitation of Liability
In no event shall Twaja be liable for:
- Any damages, including but not limited to, direct, indirect, incidental, consequential, or punitive damages;
- Any claims, demands, or actions by third parties arising from the User's use of the Service; and
- Any losses or damages resulting from the reliance on information provided through the Service.
10. Entire Agreement
These Terms of Service constitute the entire agreement between the User and Twaja regarding the use of the
Service.
11. Amendments
Twaja reserves the right to modify or update these Terms of Service at any time without notice. The User's
continued use of the Service after such modifications or updates shall be deemed acceptance of the
revised Terms of Service.
By using Makini by Twaja, the User agrees to be bound by these Terms of Service. If you do not agree with these
Terms of Service, please do not use the Service.
